1. Acceptance of These Terms
Welcome to AuraClinical. These Terms of Service ("Terms") form a binding agreement between you and AuraClinical and govern your access to and use of our patient portal, websites, mobile experiences, and all clinical and educational services — including remote telehealth consultations, mobile home visits, in-clinic facility visits, remote patient monitoring, cultural mentorship, and the learning management system (collectively, the "Services").
By creating an account, booking an appointment, signing a consent, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.
Not for emergencies. AURACLINICAL DOES NOT PROVIDE EMERGENCY MEDICAL SERVICES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM IMMEDIATELY. Do not use the Services to request emergency care.
2. Eligibility & Your Account
- You must be at least 18 years old, or an emancipated minor, or the authorized parent/legal guardian acting on behalf of a patient.
- You agree to provide accurate, current, and complete information and to keep it up to date.
- You are responsible for safeguarding your credentials, including any multi-factor authentication, and for all activity under your account. Notify us immediately of any unauthorized access. For your protection, sessions are automatically signed out after a period of inactivity.
3. Licensure & Service Area
Clinical Services are provided by Manouchka Doreus, MSN, APRN, FNP-C and affiliated licensed practitioners, only where our practitioners are licensed. Telehealth is available within the State of Florida, and mobile home visits are offered within the Jacksonville / Duval County service area. The portal verifies your service location against the practitioner's licensure before a virtual visit; if there is a mismatch, the visit may be blocked.
4. Telehealth Informed Consent
By using our telehealth Services, you consent to evaluation and treatment by audio-video and related electronic communications.
- Benefits & limitations. Telehealth improves access to care but cannot replace every in-person service; some conditions require a physical exam, in-person testing, or referral. Your clinician may determine that telehealth is not appropriate and direct you to in-person care.
- Waiting room. Visits begin in a virtual waiting room with a camera/microphone check; you join the live consultation only after your provider admits you.
- Recording. Visits are not recorded unless you are separately informed and consent. Clinical notes are documented and encrypted.
- Technology risks. Electronic systems can fail; if a connection is lost, your provider will attempt to reconnect or reschedule.
5. Remote Patient Monitoring (RPM) & Connected Devices
If you enroll a connected device (e.g., blood-pressure cuff, glucometer, pulse oximeter, or wearable):
- You must provide a separate one-time RPM authorization before any device can be activated, and you may pause or revoke any device at any time from your account, which immediately stops data collection.
- Device readings are added to your chart for your care but are not monitored in real time; they are not a substitute for emergency care or for contacting your provider about urgent symptoms.
- You are responsible for using devices according to their manufacturer instructions and for the accuracy of readings you submit.
6. Communications Consent (Email, SMS, Push)
You consent to receive transactional communications related to your care — appointment confirmations and reminders, clinical notifications, billing notices, and security alerts — by email, SMS/text, and web push. Message and data rates may apply. You may opt out of non-essential messages; certain essential communications (e.g., security or billing notices) may continue. Communications are not monitored in real time and must not be used for emergencies.
7. Prescriptions & Controlled Substances
Prescriptions are issued solely at the clinical discretion of your provider and are never guaranteed. Controlled-substance prescribing, where clinically appropriate and lawful, follows DEA Electronic Prescriptions for Controlled Substances (EPCS) requirements, including identity and multi-factor verification, and may require an in-person evaluation.
8. Fees, Insurance, Cancellations & No-Shows
- Payment. Cash-pay fees, co-pays, and deductibles are due at the time of scheduling or service and are processed securely via Stripe. We do not store raw card numbers.
- Insurance & referrals. Where insurance or referrals (HMO, PPO, Medicare, Medicaid) are used, you are responsible for obtaining required prior authorizations; non-covered services remain your financial responsibility.
- Cancellations. Appointments must be cancelled or rescheduled at least 24 hours in advance. Late cancellations and no-shows may incur a fee.
- Itemized receipts. Cash-pay patients may generate itemized superbills with CPT/ICD-10 codes for personal reimbursement.
9. Education Services (LMS)
Course content, assessments, and materials are licensed to you for personal, non-commercial use; you may not share, resell, or redistribute them. You agree not to engage in misconduct during proctored assessments. Certificates are issued only upon legitimate completion and may be independently verified by their serial number; falsifying or misrepresenting a certificate is prohibited.
10. Acceptable Use
You agree not to misuse the Services, including by attempting to breach security, access another person's records, scrape or overload the platform, upload malicious files, or use the Services unlawfully. Uploaded files are scanned for malware and may be rejected.
11. Privacy & Protected Health Information
Your Protected Health Information (PHI) is handled under HIPAA, HITECH, and applicable state law. Our Privacy Policy explains how we collect, encrypt, store, disclose, and let you access and export your information.
12. Disclaimers & Limitation of Liability
The Services are provided "as is" without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, AuraClinical and its practitioners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnification
You agree to indemnify and hold harmless AuraClinical from claims arising out of your misuse of the Services or violation of these Terms.
14. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. The parties will first attempt to resolve disputes informally. Where permitted by law, disputes not resolved informally will be settled by binding arbitration on an individual basis; you may opt out of arbitration in writing within 30 days of accepting these Terms. This section does not waive any non-waivable patient rights.
15. Changes to These Terms
We may update these Terms. Material changes will be posted with a new "Last updated" date, and you may be prompted to review and re-accept. Continued use after changes constitutes acceptance.
